Polygamy and the Notwithstanding Clause


The Calgary Herald weighs in on the recent legal proceedings and polygamy charges against Bountiful, British Columbia Fundamentalist Church of Jesus Christ of Latter Day Saints leaders Winston Blackmore and James Oler and the implications of the province using Section 33 (Notwithstanding Clause) of the Charter of Rights and Freedoms to intervene in any future constitutional rulings on marriage. Many argue the precedent set by Ottawa’s legalization of same-sex marriage in 2005 weakens the case against polygamous unions, further weakening the role and place of traditional marriage nationwide.
